More work will be needed to improve the Law on the Origin of Property

The European Commission (EC) is considering the Draft Amendments to the Draft Law on Confiscation of Proceeds from Crime (Law on the Origin of Property), it was told the TVCG in Brussels, adding that the proposal needs to be further improved.

"After the first preliminary assessment, it seems that more work will be needed to improve it, based on European standards and best practices. The comments will be submitted to the Montenegrin authorities as soon as possible," EC spokeswoman Ana Pisonero Hernandez told TVCG.

Pisonero points out that, as stated in the annual reports of the European Commission, it is necessary to further improve the results of Montenegro in the seizure and confiscation of property acquired through crime in cases of corruption and organized crime.

"In particular, the legal framework must be revised and effectively implemented in order to improve the overall fight against corruption and organized crime. Legal barriers to effective financial investigations, confiscation of assets and property restitution frameworks need to be addressed urgently. This is even more important in the current context,’’ Pisonero said.

The European Commission welcomed Montenegro's ongoing good practice of consulting with the European Commission on draft laws in the area of the rule of law.
