Government for a non-working Sunday

The Government accepted the opinion of the Ministry of Economy, which adopted the Constitutional Act that proposes that the court reject the initiative to initiate the assessment procedure constitutionality of the article of the Law on Internal Trade, which provides ban on work for dealers on Sundays.

The initiative was submitted to the Constitutional Court in September by the Employers Union (UPCG).

The ministry submitted an opinion to the executive at Thursday's session proposing that the Constitutional Court reject this initiative.

In its opinion, the ministry recalled the views of the UPCG, among other things, that the applicant, from the aspect of discrimination, considers that it can be expected that a ban on Sunday trading would lead to a loss of a significant number of jobs, which will deepen inequality at labor market, because most of the female population will be affected by termination of employment contract.

By the disputed provision, according to UPCG, are affected those traders who respect the rights of the employees as a whole.

The petitioner states that the impugned Sunday ban on work, due to the omission in the enactment process was not sufficient reason to such a standard, especially if working hours, vacations and other labor rights content of system law - the Labor Law.
